Welcome to Prolific Audio LLC’s website (the “Site”). These Terms and Conditions (“Terms”) govern your use of the Site and the purchase of any products or services through the Site. By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
1. Use of the Site
1.1. Eligibility: You must be a business that sells to consumers offline in a retail environment. We do not allow any selling online, and it is strictly forbidden.
1.2. Account: You may need to create an account to access certain features of the Site. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2. Products and Services
2.1. Product Information: All information is listed to the best of our abilities. Some errors may be present. Please ask if you are unsure.
2.2. Pricing: If a pricing error is encountered, we have the right to cancel the order and refund the payment.
2.3. Orders: All parts are custom-made, and we try to have multiple parts ready to go. Although we strive to get orders out the same day or the next, it is not guaranteed. If you need an order by a certain timeframe, please contact us before placing the order. Once orders are placed, it is at our discretion whether we can cancel the order, depending on if the order has been processed or not.
3. Payment and Shipping
3.1. Payment: All payments must be made through the payment methods provided on the Site. You agree to provide accurate and complete payment information.
3.2. Shipping: We offer free freight for orders over $500. Our preferred shipment method is UPS. Deliveries must be made to the address on your business credit card and must also be the place where you do business.
4. Returns and Refunds
4.1. Return Policy: All orders are custom-made and packed. We do not offer any returns without prior authorization. If authorized, refunds will be made within 7 days. Defective products will be replaced at no cost to the dealer.
5. Intellectual Property
5.1. Ownership: All content on the Site, including text, graphics, logos, images, and software, is the property of Prolific Audio LLC or its content suppliers and is protected by intellectual property laws.
5.2. Use: No images from our website are allowed to be used in any marketing without prior consent.
6. Limitation of Liability
To the fullest extent permitted by law, Prolific Audio LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or the purchase of products through the Site.
7. Indemnification
You agree to indemnify and hold Prolific Audio LLC harmless from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Site or violation of these Terms.
